Reliance Jio sends a justification to Trai in the offer 'Happy New Year'

Reliance Jio billionaire Mukesh Ambani told telecoms regulator Trai that his latest voice and data offer does not violate any of the existing rules that require promotional offers to be limited to 90 days.

Responding to the clarification requested by the Indian Telecommunications Regulatory Authority (TRAI) regarding the extension of the free call and data offer until March 31 after the 90-day promotional period expired on December 4, Jio sent A detailed note explaining how his '' was different from the inaugural offer and does not qualify to be called as a predator.

Sources with direct knowledge of the development said that the company explained in detail how the new offer can not be qualified as an extension of the promotional offer because it is different from the inaugural offer launched in early September.

The response was to Trai's letter dated December 20, in which the regulator asked the company why its 'Happy New Year Offer' should not be considered as a 'violation' of the regulatory guidelines and also why Offer free data under the promotional scheme should not be treated as "predators".

Jio has maintained that Happy New Year's latest offer is substantially different from Jio's welcome offer (which began Sept. 5), as 4GB of free data was offered per day on the initial offer, while the same offer Was limited to 1GB. Fair Use Policy) in the new offer.

Jio is also believed to have emphasized that rate plans have multiple components and if even a single component is altered, it can not be interpreted as the same offer or its extension.

In addition, they say that in the first offer there was no option of renewal or payment after the 4GB limit is exhausted, but in the new offer you can recharge both the data and the promised speed.

Regarding the dominant position in the market, Reliance Jio is six percent of the facilities in the country, while the rules of the Indian Competition Commission (ITC) specify a threshold of 30 percent to trigger the clause Of "abuse of market dominance".

Airtel Challenges TRAI's Decision to Extend Free Reliance Services for Jio offer till 31st march 2017

Bharti Airtel has moved the TDSAT court against TRAI, allowing Reliance Jio, Mukesh Ambani's leader, to continue the free promotional offer beyond the stipulated 90 days, accusing the regulator of being a "silent viewer" of the violations. In its 25-page TDSAT petition, India's largest private mobile operator has asked the quasi-judicial body to direct TRAI to ensure that Jio does not provide its free voice and data plan beyond 3 December.

It alleged that the violation of TRAI tariff orders has continued since March 2016, causing "significant loss and daily loss" to TRAI and "affecting its network" as it has asymmetric traffic due to the free call offer from Jio. Jio launched for the first time an inaugural plan of voice and data from the 4 of September and this month extended it until the 31 of March.

Giving reasons for his request, Airtel said that the "free services" continue in flagrant violation of the Directorates, Tariff Orders and the TRAI Regulation with "TRAI as a dumb spectator."

When the petition was referred to a TDSAT court today, Jio's lawyer was present and asked to be presented as a party to the case. TRAI said it needs 10 more days to make a decision.
TDSAT ordered TRAI to return with its decision the following day and ordered Jio to submit a request for implementation. The next hearing date is set for January 6, 2017.

Airtel in the petition alleged that TRAI in its October 20 decision "erroneously concluded" that since the promotional offer of Jio's free services was only valid until December 3, it is consistent with TRAI's "90-day" addresses .

"TRAI, moreover, without giving any reasoning critically and in a non-transparent way, violating Article 11 (4) of the TRAI Act concluded that the tariff plans offered by said TSP are not incompatible with the IUC and arenot predatory and discriminatory at present. The contested decision of TRAI is thus bad in the law and deserves to be annulled, "he said.
